Terms of Service

These Terms of Service ("Terms") govern your use of WebDialogAI's platform, including the dashboard, APIs, chat widget, and documentation (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Definitions​

  • "Customer" — a business or individual who registers for a WebDialogAI account
  • "End User" — a visitor who interacts with a chat widget powered by WebDialogAI
  • "Platform" — the WebDialogAI SaaS application, APIs, and related services

2. Account Registration​

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may not maintain more than one account without prior approval

3. Acceptable Use​

You agree not to:

  • Use the Service for any unlawful purpose
  • Transmit malicious code, spam, or harmful content through the chat widget
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without authorization
  • Use the Service in a way that could damage, disable, or impair it

4. AI-Powered Responses​

  • The Service uses AI models (including Anthropic Claude and OpenAI GPT) to generate chat responses
  • AI responses are generated automatically and may not always be accurate
  • Customers are responsible for configuring their AI assistant's knowledge base and behavior
  • WebDialogAI is not liable for the accuracy of AI-generated responses
  • Customers should review and monitor AI responses to ensure they meet their standards

5. Data and Privacy​

  • Our collection and use of data is governed by our Privacy Policy
  • Customers are responsible for providing appropriate privacy notices to their End Users
  • Customers must ensure their use of the Service complies with applicable data protection laws
  • We offer a Data Processing Agreement for customers who require one

6. Intellectual Property​

  • WebDialogAI retains all rights to the Service, including its software, design, and documentation
  • Customers retain ownership of their content, including knowledge base data and conversation history
  • The chat widget may display "Powered by WebDialogAI" branding unless a plan allows removal

7. Service Availability​

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with reasonable advance notice
  • We are not liable for downtime caused by factors outside our control

8. Subscription and Payment​

  • Subscription plans, pricing, and features are as described on our website
  • Payments are billed in advance on a monthly or annual basis
  • Refunds are handled on a case-by-case basis

9. Termination​

  • Either party may terminate the agreement with 30 days' written notice
  • We may suspend or terminate accounts that violate these Terms immediately
  • Upon termination, Customers may export their data within 30 days

10. Limitation of Liability​

To the maximum extent permitted by law, WebDialogAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claim shall not exceed the amount paid by the Customer in the 12 months preceding the claim.

11. Indemnification​

Customers agree to indemnify WebDialogAI against claims arising from their use of the Service, their content, or their violation of these Terms.

12. Changes to Terms​

We may update these Terms from time to time. We will notify Customers of material changes at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law​

These Terms are governed by the laws of the jurisdiction in which WebDialogAI is incorporated, without regard to conflict of law principles.
